Legal Notice
These legal notices and terms of use (hereinafter "Legal Notice" and/or "Website Terms of Use") govern the relationship between the User and the Data Controller with regard to the services offered through this website www.progold.com (hereinafter the "Site"). All Content relating to this Site is the exclusive and reserved property of the Site owner and/or the persons indicated therein and/or their successors in title. All Content is protected by applicable national and international Intellectual and/or Industrial Property law. By accessing and browsing the Site, the User accepts this Legal Notice without limitation or reservation.
Definitions
- Site means any Content and element, including technical/IT elements, of the Site itself;
- Data Controller means Progold S.p.A., with registered office in Via Postale Vecchia n. 26/A – 36070 Trissino (VI), Italy;
- User means any person accessing the Site;
- Intellectual and/or Industrial Property Rights means all rights protected by applicable national and international law relating to copyright and industrial property, including, by way of example, trademarks (including those used de facto by the Data Controller), distinctive signs, patents, trade names, brands, domain names, databases and applications;
- Content means, by way of example, text, images, video and audio of any format, reproductions of logos and trademarks (including de facto ones), technical and graphic works, design, and databases.
All Intellectual and/or Industrial Property Rights are expressly reserved for all countries, and any infringement will be prosecuted. The User is responsible for complying with the terms of use of the Site's Content and is personally liable for any unlawful use, and shall hold the Data Controller harmless where the User's conduct infringes the rights of third parties.
The Site's Content may not be used except with the Data Controller's authorisation, which is deemed granted subject to the following conditions: the Data Controller and/or its successor in title and/or the author of the Content used must always be credited, the source and web address must be cited, and the Content must be used without any modification. It is not permitted to modify the Site's Content in any way, nor to reproduce it, publicly transmit it, perform it, distribute it, or otherwise use it for advertising purposes. Distinctive signs, trademarks, domain names, logos, content, text, images and design — unless otherwise indicated — are the property of the Data Controller.
The Data Controller cannot be held responsible for the use the User makes of the information contained in the Site's Content. The presence of links to third-party websites other than the Data Controller's does not entail, and shall not entail, any liability on the part of the Data Controller for the content of such sites, nor does it imply any endorsement of, or agreement with, the content of such sites. The Site's Content, prepared by the Data Controller, has been carefully reviewed and checked; however, inaccuracies, errors or omissions may nonetheless be present. Under no circumstances shall the Data Controller be held liable for such errors, inaccuracies or omissions, nor for any reliance the User has placed on the Site's Content. The Data Controller reserves the right to make changes at any time, without notice, to the materials and services on the Site or to the products indicated therein. Registering on the Site
Access to certain pages of the Site and the use of certain services are reserved exclusively for registered Users. The User undertakes to read these Terms of Use before accessing the services offered by the Data Controller and registering on the Site. With regard to the processing of the User's personal data, please refer to the Privacy Policy.
The User may access the services offered exclusively to registered Users only after registering on the Site and creating a personal account. The account consists of the personal registration the User carries out on the platform made available by the Data Controller, by choosing authentication credentials. The credentials chosen by the User, together with the other data required for registration as indicated in the form, constitute the User's virtual identifier. Providing the mandatory data is necessary for the registration process: failure to provide it will prevent proper registration on the Site and use of the services reserved for registered Users. Failure to give consent for sending newsletters and commercial communications, on the other hand, has no effect on the registration process.
Account creation is reserved solely for Users acting as professionals, and not as consumers, pursuant to Art. 3 of Italian Legislative Decree No. 206/2005, as amended. At the time of registration, the User declares, under its sole responsibility, that it acts as a professional and not as a consumer, and that every purchase will be made in the course of its business, trade or profession. The User warrants and certifies the accuracy and correctness of the data and information provided.
Each account is personal and may not be transferred to third parties. The User is responsible for safekeeping and using its own authentication credentials and is deemed the author of any activity carried out using them, unless it demonstrates that it suffered, through no fault of its own, unauthorised use of its account. The User undertakes to promptly notify the Data Controller of any discovery of identity theft or unauthorised use of its account, so that appropriate protective measures can be adopted.
The Data Controller reserves the right to supplement, modify and update this Legal Notice at any time; the updated version will be published on this page, which shows the last update date. Use of the Site by the User following such changes constitutes acceptance of those changes.
Registration and possession of an account allow the User to place orders, download its own documents, track order status and file complaints. Creating an account does not commit the User to purchasing the Data Controller's products or services. If access credentials are lost or forgotten, the User can recover them via the procedure available on the login page.
The User may request the deletion of its account at any time by sending a request to the email address indicated on this page. Once deletion has been carried out and confirmed, it will no longer be possible to access the services reserved for registered Users. Even after deletion, some of the User's data may still be processed by the Data Controller for accounting, tax and administrative purposes required by applicable law, for the period prescribed by law. For any issue or difficulty in managing the account, the User may write to the same address.
